Case Brief
The Reserve Bank of India cancelled the Certificate of Registration of four NBFCs: Psychotropics Leasing and Finance Private Limited, Saan Popular Finance Private Limited, Classic Leafin Private Limited, and Alka Mercantile Private Limited (now known as Surbhi Mercantile Private Limited). The action was taken under Section 45-IA(6) of the RBI Act, 1934. Following cancellation, these companies are barred from transacting business as non-banking financial institutions under Section 45-I(a) of the Act.
Why RBI Acted
The Reserve Bank of India exercised its powers under Section 45-IA(6) of the RBI Act, 1934 to cancel the Certificate of Registration of four companies: Psychotropics Leasing and Finance Private Limited, Saan Popular Finance Private Limited, Classic Leafin Private Limited, and Alka Mercantile Private Limited (presently known as Surbhi Mercantile Private Limited). As a result, these entities cannot transact the business of a Non-Banking Financial Institution as defined in Section 45-I(a) of the RBI Act, 1934.
Operating Impact
The four named companies must stop operating as NBFCs and cannot legally transact non-banking financial institution business. This affects their ability to originate or conduct NBFC activities going forward, but no monetary penalty is mentioned in the release.
