Case Brief
On 8 March 2007, the Reserve Bank of India cancelled the Certificate of Registration of M/s. Dotch Tie-up Pvt. Ltd., Kolkata under Section 45-IA(6) of the RBI Act, 1934. Why RBI Acted
The Reserve Bank of India cancelled the Certificate of Registration granted to M/s. Dotch Tie-up Pvt. Ltd., Kolkata on 8 March 2007 under Section 45-IA(6) of the RBI Act, 1934. As a consequence, the company can no longer transact the business of a non-banking financial institution. The release further states that the company is prohibited from acceptance of public deposits under Section 45MB(1) and from alienation of assets under Section 45MB(2) of the RBI Act, 1934, while remaining obligated to repay any deposits in accordance with contract terms.
Operating Impact
The company loses permission to conduct NBFC business going forward. It cannot accept public deposits or transfer assets, and it must still honour repayment obligations for any deposits already accepted. Existing depositors are affected by the repayment requirement, but no new NBFC business may be undertaken.
