Case Brief

The Reserve Bank of India cancelled the Certificate of Registration of thirteen companies under Section 45-IA(6) of the RBI Act, 1934. The companies listed include Embro Finvest Limited, KMG Macro Investments Private Limited, Shri Sukta Investment & Finance Private Limited, Sun Invest Associates Limited, Swaws Credit Corporation India Private Limited, Sun-Star Securities and Credits Private Limited, Supermax Fincap Private Limited, Signatureglobal Capital Private Limited, Nadia Printing & Packaging Private Limited, Savera Securities Private Limited, Adinath Investment and Trading Company, Ankur Services and Growth Fund Limited, and ARG Financial Services Private Limited. Following the cancellation, they shall not transact the business of a Non-Banking Financial Institution as defined in clause (a) of Section 45-I of the RBI Act, 1934.

Why RBI Acted

Licensing breach

The Reserve Bank of India exercised its powers under Section 45-IA(6) of the RBI Act, 1934 to cancel the Certificate of Registration of thirteen companies. As a result, these entities are no longer permitted to transact the business of a Non-Banking Financial Institution as defined in Section 45-I(a) of the RBI Act.

Operating Impact

The affected companies lose authorization to conduct NBFC business and must stop carrying on non-banking financial institution activities. Customers and counterparties should not treat them as licensed NBFCs for new business.
